1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you and NameSet ("Company," "we," "us," or "our"), concerning your access to and use of the NameSet browser extension and the nameset.me website.

BY ACCESSING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY ALL OF THESE TERMS.

2. Description of Service

NameSet provides a suite of tools for brand identity orchestration, including but not limited to automated form-filling, identity injection, and brand portfolio management.

3. Monetization and Financial Terms

3.1 Brand-per-Token Model: NameSet utilizes a non-subscription, credit-based monetization model. Users purchase "Brand Tokens" to unlock premium management features for a specific brand identity.

3.2 The "Burn" and Refund Policy

  • ALL SALES ARE FINAL. Once a token has been burned, it cannot be refunded, returned, or transferred.
  • Tokens are consumed at the point of "Unlocking" a brand or upon reaching free-tier usage limits.
  • NameSet is not responsible for user errors, including typos in brand names or subsequent pivots.

3.3 Merchant of Record: Billing and global tax compliance are managed by our Merchant of Record, Polar.sh.

4. Automation and Platform Risks

NameSet uses advanced automation techniques. You acknowledge that third-party platforms (Instagram, X, TikTok, etc.) may have strict policies against automated interaction. NameSet shall NOT be held liable for any account restrictions, shadowbans, or loss of access resulting from the use of our automation engine.

5. Prohibited Activities

You may not use NameSet for cybersquatting, handle-sniping, mass-registration of accounts for spam, or attempting to bypass the Service's monetization logic. Any breach results in immediate account termination and forfeiture of credits.

6. Limitation of Liability

IN NO EVENT WILL WE OR OUR DEVELOPERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA.

7. Governing Law

These Terms shall be governed by and defined following the laws of the State of Delaware, United States.
